Each business entity operating in the field of water use must obtain a permission issued by the State Agency of Water Resources of Ukraine and its territorial bodies.
Obtaining a permission for special water use is mandatory for those entities that carry out water abstraction from water bodies using structures or technical devices, water use and discharge of pollutants into water bodies, including water abstraction and discharge of pollutants with return waters with the use of canals (Article 48 of the Water Code of Ukraine).
Special water use is carried out by legal entities and individuals primarily to meet the drinking needs of the population, as well as for household, medical, health, agricultural, industrial, transport, energy, fisheries and other state and public needs.
The form of the permission for special water use and the form of normative calculation of water use and drainage are approved by the order of the Ministry of Environment dated 23.06.2017 № 234 (registered in the Ministry of Justice of Ukraine on 31.07.2017 at № 887/30755-888/30756).
The form of normative calculation of water use and drainage stipulates that a legal person or individuals, a private entrepreneur fills it in, taking into account each place of water use and each return water discharge within one region or city of Kyiv.
The permission for special water use sets a water intake limit, a water use limit and a pollutant discharge limit.
